Terms of Use

1. Definitions

1.1 Service. The Classy Cars Bid website, applications, auction listings, bidder tools, messaging, and related features operated by Classy Cars Bid ('we', 'us', 'our').

1.2 User. Any individual or entity that accesses the Service, whether as a visitor, bidder, seller, or registered account holder.

1.3 Content. All text, photographs, descriptions, vehicle specifications, bid data, and other material submitted to or displayed through the Service.

2. Acceptance of Terms

2.1 You must be at least 18 years old and legally capable of entering binding contracts in your jurisdiction to use the Service.

2.2 By placing a bid, listing a vehicle, or creating an account, you represent and warrant that you have read, understood, and agreed to these Terms and our Privacy Policy and Cookie Policy.

3. Description of Service

3.1 Classy Cars Bid provides an online marketplace where sellers list collector vehicles for time-limited auction, and buyers place competitive bids.

3.2 We facilitate listings, bidding, and buyer-seller communication. We are not a party to the vehicle sale unless expressly stated; title and payment are exchanged directly between buyer and seller via our recommended escrow process.

4. User Conduct & Prohibited Uses

You agree not to:

• Place a bid you do not intend to honor, or coordinate bids to manipulate prices.
• Misrepresent a vehicle's condition, history, ownership, or VIN.
• Use the Service to launder funds, transmit malware, or harass other users.
• Scrape, reverse-engineer, or resell Service content without written consent.
• Create multiple accounts to evade limits or suspensions.

5. Intellectual Property

5.1 All Service features, UI, graphics, and editorial copy are owned by Classy Cars Bid or its licensors and protected by applicable intellectual property laws.

5.2 Sellers retain ownership of the photos and descriptions they submit but grant us a worldwide, non-exclusive, royalty-free license to host, display, and promote those materials for the duration of the listing and historical archive.

6. Termination

6.1 We may suspend or terminate your account for breach of these Terms, suspected fraud, or conduct that materially harms the Service or its users.

6.2 On termination, in-progress bids may be withdrawn at our discretion, and you will be notified at the email on file. Data retention is governed by our Privacy Policy.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. CLASSY CARS BID MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE SERVICE OR THE INFORMATION, CONTENT, VEHICLE DESCRIPTIONS, PHOTOGRAPHS, BIDS, OR PRICES. TO THE FULLEST EXTENT PERMISSIBLE BY LAW, CLASSY CARS BID DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

8. Limitation of Liability

IN NO EVENT SHALL CLASSY CARS BID, ITS OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFIT, DATA, OR GOODWILL, ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE SERVICE — EVEN IF CLASSY CARS BID HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID TO CLASSY CARS BID IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

9. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email to registered accounts and posted on this page with a revised Effective Date. Continued use of the Service after the effective date constitutes acceptance.

10. Governing Law & Dispute Resolution

10.1 These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules.

10.2 Any dispute arising out of or relating to these Terms or the Service shall be resolved by binding arbitration in San Francisco County, California, administered by JAMS under its Streamlined Arbitration Rules, except that either party may seek injunctive relief in court for intellectual property infringement.

10.3 Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
